Inktank.ai Terms of Service

Welcome to Inktank.ai ("Site"), a platform operated by SquidInk Labs. ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Site, including creating profiles, prompts, favoriting, sharing, and searching prompts. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Use of the Site
Eligibility: You must be at least 13 years old to use the Site. By using the Site, you represent that you meet this requirement and have the legal capacity to agree to these Terms.
Account Creation: You may create a profile using accurate and truthful information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Features:
- Prompt Creation: You can create standard or templated prompts. We use AI to annotate prompts with tags, names, and descriptions. You may attribute prompts to give credit to their source.
- Favoriting and Sharing: You can favorite prompts for personal reference and share prompts with others via the Site’s tools.
- Searching: You can search for prompts created by other users.
Acceptable Use: You agree to use the Site only for lawful purposes. You will not:
- Post or share content that is unlawful, harmful, defamatory, obscene, or infringes on others’ rights.
- Engage in spamming, hacking, or any activity that disrupts the Site.
- Misrepresent the source or ownership of prompts.
We reserve the right to suspend or terminate your account for violating these Terms, at our sole discretion.
2. Ownership and Licensing
Your Prompts: You retain all ownership rights to the prompts you create or share on the Site. By submitting prompts, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and use prompts you create solely to operate and provide the Site’s services (e.g., AI annotation, search functionality, and sharing features). We do not claim ownership of your prompts.
Attribution: You may attribute prompts to their original source. You are responsible for ensuring the accuracy of any attribution and that you have the right to share attributed content.
AI Annotations: Tags, names, and descriptions generated by our AI are provided for convenience. We do not guarantee their accuracy or suitability, and you may not claim ownership over AI-generated annotations.
3. User Responsibilities
You are solely responsible for the content you submit, including prompts, attributions, and profile information. You represent and warrant that:
- Your content does not violate any third-party rights (e.g., copyright, trademark, privacy).
- You have the necessary permissions to share any attributed prompts or content.
4. No Warranty and Limitation of Liability
No Warranty: The Site is provided "as is" without warranties of any kind, express or implied, including accuracy, reliability, or fitness for a particular purpose. We do not guarantee that the Site will be error-free, secure, or uninterrupted.
Limitation of Liability: To the fullest extent permitted by law, we (and our affiliates, officers, employees, and agents) will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use newborns, or inability to use the Site, including damages related to prompts, AI annotations, or third-party actions.
5. Indemnification
You agree to indemnify, defend, and hold harmless [Your Name/Business Name], its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Site.
- Your prompts, content, or actions on the Site.

6. Intellectual Property
Our IP: The Site, including its design, code, and AI annotation tools (excluding user prompts), is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our IP without permission.

7. Termination
We may suspend or terminate your access to the Site at any time, for any reason, including violation of these Terms. Upon termination, your right to use the Site ends, but your prompts may remain on the Site unless you request removal (subject to our discretion and technical feasibility).

We may update these Terms at any time by posting the revised version on the Site. Continued use of the Site after changes constitutes your acceptance of the updated Terms.
9. Governing Law
These Terms are governed by the laws of Texas USA, without regard to conflict of law principles. Any disputes will be resolved in the courts of Hays County, Texas.
